Unmuted Photography, Terms and Conditions
These Terms and Conditions apply to all bookings, photography sessions, services, digital images, printed products and related services provided by Unmuted Photography.
By making a booking, paying a booking fee, attending a photography session or using any images supplied by Unmuted Photography, you agree to these Terms and Conditions.
1. About Unmuted Photography
Unmuted Photography provides personal branding photography, headshot photography, portrait photography and related creative services for women, including planning, styling guidance, positioning support, image creation and delivery of edited digital photographs.

2. Definitions
In these Terms and Conditions:
“Unmuted Photography”, “we”, “us” or “our” means the photography business providing the services.
“Client”, “you” or “your” means the person, business or organisation making the booking.
“Booking” means the agreed photography session, service, package or creative project.
“Session” means the photography shoot or any part of the photography service delivered in person or remotely.
“Images” means the photographs created by Unmuted Photography, including edited digital files, previews, proofs, galleries, printed products and any other photographic material.
“Gallery” means the online gallery or digital delivery method used to provide proofs, selections or final edited images.
“Booking Fee” means the amount paid to secure your session date and time.
“Final Balance” means the remaining amount payable after the Booking Fee has been paid.
3. The Contract
A contract is formed between you and Unmuted Photography when:
-
you confirm that you wish to book a session or service;
-
we confirm availability and the relevant package or service details;
-
you pay the required Booking Fee, deposit or full session fee; and
-
we confirm your booking in writing by email, message, invoice or booking confirmation.
These Terms and Conditions apply to the contract unless we agree different terms with you in writing.
4. Services and Packages
Unmuted Photography offers a range of personal branding and portrait photography services. The exact service, session length, image allowance, planning support, styling support, wardrobe guidance, usage rights, location and any extras will be confirmed at the point of booking.
Package names, inclusions, pricing and availability may change from time to time. The package you purchase will be the package confirmed to you at the time of booking.
Unless expressly stated otherwise, prices do not include travel, parking, accommodation, venue hire, hair and make-up, additional assistants, printed products, extended licensing or additional editing requests.
5. Booking Fee and Payment Terms
A Booking Fee is required to secure your session date and time.
Unless agreed otherwise in writing:
-
the Booking Fee is payable at the time of booking;
-
the Booking Fee secures the agreed session date and prevents that date being offered to another client;
-
the Final Balance must be paid no later than 7 days before the session date;
-
where a session is booked less than 7 days before the session date, the full fee is payable at the time of booking;
-
no session will take place until all amounts due before the session have been paid in full.
For business clients, payment terms will be stated on the invoice. Late payments may result in delayed delivery of images, suspension of services or cancellation of the booking.
We reserve the right to charge statutory interest and reasonable debt recovery costs on overdue business invoices in accordance with applicable UK law.
6. Prices
All prices will be confirmed at the time of booking.
Prices are subject to change, but any price change will not affect a confirmed booking unless you request a change to the booking, package, location, date, usage licence or scope of work.
Any additional products or services requested after booking will be charged separately. These may include, but are not limited to:

additional edited images;
-
extended retouching;
-
additional shoot time;
-
extra locations;
-
additional people;
-
travel costs;
-
location or venue fees;
-
rush delivery;
-
printed products;
-
enhanced commercial usage rights.
7. Rescheduling by the Client
We understand that life happens and will always try to be fair and practical.
If you need to reschedule your session, you must tell us as soon as possible in writing.
Unless agreed otherwise:
-
if you reschedule more than 14 days before the session date, we will usually transfer your Booking Fee to a new date, subject to availability;
-
if you reschedule between 7 and 14 days before the session date, we may transfer your Booking Fee to a new date at our discretion;
-
if you reschedule less than 7 days before the session date, we may treat this as a cancellation and a new Booking Fee may be required;
-
only one reschedule is included as standard, unless we agree otherwise in writing;
-
any new session date must usually take place within 3 months of the original date.
If the reason for rescheduling is illness, emergency, severe weather or circumstances outside your control, we will discuss the situation with you and try to find a reasonable solution.
8. Cancellation by the Client
If you wish to cancel your booking, you must tell us in writing.
Cancellation charges are intended to reflect the work already carried out, costs incurred, preparation time, loss of the session date and the likelihood of being able to rebook that date.
Unless agreed otherwise in writing:
-
cancellation more than 14 days before the session date may result in the Booking Fee being retained, but no further session fee being payable;
-
cancellation between 7 and 14 days before the session date may result in up to 50% of the total session fee being payable;
-
cancellation less than 7 days before the session date may result in up to 100% of the total session fee being payable;
-
if we are able to rebook the session date with another client, we will take this into account when calculating any cancellation charge.
Where you are a consumer and statutory cancellation rights apply, nothing in these Terms and Conditions affects those rights.
9. Consumer Cooling Off Rights
If you book online, by email, by telephone or away from our business premises as a consumer, you may have a legal right to cancel within 14 days of entering into the contract.
However, where you ask us to begin work during the 14 day cancellation period, including planning, consultation, preparation, shoot planning, creative direction, styling advice, location planning, administration or the photography session itself, you agree that we may charge you a reasonable amount for the work carried out up to the point of cancellation.
If the service has been fully performed with your agreement during the cancellation period, you may lose the right to cancel that service.
If digital images are supplied to you during the cancellation period and you have consented to receiving digital content before the end of that period, you may lose your right to cancel in relation to that digital content once it has been supplied.
These terms do not remove any rights you may have under UK consumer law.
10. Cancellation or Rescheduling by Unmuted Photography
We will make every reasonable effort to attend and deliver your session as agreed.
In rare circumstances, we may need to cancel or reschedule due to illness, emergency, equipment failure, unsafe conditions, severe weather, venue issues or circumstances beyond our control.
If this happens, we will offer you one of the following:
-
a new session date;
-
an alternative photographer, where appropriate and agreed by you;
-
a refund of any amounts paid for services not yet provided.
Our liability for cancellation by us is limited to the amount paid by you for the affected service.
We are not responsible for additional costs you may incur, including travel, accommodation, clothing, hair and make-up, childcare, venue hire, third party supplier fees or loss of business opportunity.
11. Client Responsibilities
You agree to:
-
provide accurate contact and booking information;
-
arrive on time for your session;
-
pay all amounts due by the relevant deadline;
-
tell us about any relevant access needs, health considerations, sensitivities, preferences or concerns before the session;
-
obtain any permissions required for locations, venues, premises, products, props, people or branding included in the shoot;
-
ensure that clothing, props, products, branding materials and personal items are ready and suitable for the session;
-
ensure that any other people attending the session behave appropriately and follow reasonable instructions;
-
respect the studio, venue, equipment and any third party property used during the session.
If you are late, the session may still need to end at the agreed time. Additional time is not guaranteed and may be charged separately.
12. Creative Style and Artistic Discretion
By booking Unmuted Photography, you acknowledge that you have reviewed our style and chosen us because you are happy with our creative approach.
Photography is a creative service. The final images will reflect our artistic judgement, including decisions about lighting, posing, composition, colour, crop, editing, expression, mood and final image selection.
We do not guarantee that every pose, idea, inspiration image, backdrop, outfit, location or requested shot will be possible or successful.
We will always aim to create images that feel powerful, flattering, aligned with your brand and true to the Unmuted Photography style.
13. Image Selection and Editing
Unless agreed otherwise, Unmuted Photography will select the best images from the session for editing, proofing or gallery delivery.
Not every image taken during the session will be supplied. Images may be removed due to blinking, duplication, missed focus, unflattering expression, lighting issues, technical issues or artistic judgement.
Final edited images will receive our standard professional editing. This may include colour correction, exposure adjustment, cropping, tonal editing, light skin retouching and overall polish.
Standard editing does not include extensive retouching unless stated in your package. Extensive retouching may include body reshaping, major skin work, object removal, background reconstruction, clothing alteration, hair editing, composite work or other advanced changes. These may be charged separately.
Raw files and unedited images are not supplied.
14. Gallery Delivery
Your final images will usually be delivered via an online gallery or digital download link.
Delivery times will be confirmed at booking or after the session. Any delivery timeframe is an estimate unless we specifically agree a fixed deadline in writing.
Delays may occur due to illness, technical issues, high workload, client selection delays or circumstances beyond our control.
Once your gallery is delivered, you are responsible for downloading and safely storing your images.
Online galleries are not permanent storage. We recommend that you back up your images in more than one place.
We may archive or remove galleries after a reasonable period. A gallery re-upload or archive retrieval may incur an administration fee.
15. Image Storage and Loss
We take reasonable care to store and back up images during the editing and delivery process.
However, digital files can be vulnerable to corruption, loss, theft, hardware failure, software failure or other technical issues.
Our liability for loss, corruption or non delivery of images is limited to the amount paid by you for the affected service.
Once images have been delivered, responsibility for safe storage passes to you.
16. Usage Rights for Personal Branding Clients
Unless agreed otherwise in writing, your package includes a licence to use your final edited images for your own personal brand and business marketing.
This usually includes use on:
-
your website;
-
social media profiles;
-
social media posts;
-
email marketing;
-
business profiles;
-
speaker profiles;
-
podcast or press biographies;
-
printed marketing for your own business;
-
internal business documents;
-
online directories and professional platforms.
You may not sell, transfer, sub licence or give the images to a third party for their own commercial use without our written permission.
Examples of third party commercial use may include use by another brand, agency, publication, advertiser, stock image platform, course provider, event organiser, magazine, product company or commercial partner.
If you require wider commercial usage, paid advertising usage, publication usage, campaign usage or third party licensing, this must be agreed separately in writing and may incur an additional fee.
17. Copyright
Copyright in all images remains with Unmuted Photography, unless expressly transferred in writing.
You are granted a usage licence for the final edited images supplied to you, according to the package or agreement purchased.
You must not:
-
claim that you created the images;
-
sell the images as stock photography;
-
enter the images into competitions without permission;
-
apply heavy filters or edits that materially alter the final image;
-
allow other businesses or suppliers to use the images commercially without permission;
-
remove watermarks from proof images;
-
use screenshots, previews or unlicensed images.
Where possible, we appreciate credit when images are shared online, but credit is not required unless specifically stated in your package or agreement.
18. Social Media and Portfolio Use by Unmuted Photography
We would love to share the images we create, but we understand that personal branding photography can feel deeply personal.
Unless you tell us otherwise in writing, you agree that Unmuted Photography may use selected final images for portfolio, website, social media, awards, marketing, advertising, printed materials, editorial features and promotional purposes.
If your images are confidential, commercially sensitive, subject to a launch date or you would prefer us not to share them, you must tell us in writing before the session.
We will respect any agreed confidentiality restrictions.
19. Confidentiality and Sensitive Information
We will treat your personal information and any confidential business information with care.
If you disclose sensitive information during planning or during the session, we will not intentionally share it without your consent, unless required by law.
If your images relate to an unreleased brand, product, service, campaign, personal announcement or business launch, you must tell us about any confidentiality requirements in writing before the session.
20. Client Supplied Materials
If you provide brand assets, products, props, clothing, logos, documents, locations, mood boards, creative references or other materials, you confirm that you have the right to use them in the session.
You are responsible for ensuring that any third party intellectual property, trademarks, copyrighted material or branded items can lawfully appear in the images.
We are not liable for claims arising from materials supplied or requested by you.
21. Hair, Make-up, Styling and Third Party Suppliers
Where hair, make-up, styling, wardrobe advice, venue hire or any other third party service is arranged, the terms of that supplier may also apply.
Unless we have expressly included a third party service within our invoice, you are responsible for paying that supplier directly.
We are not liable for the acts, omissions, delays, cancellations, products, allergic reactions, results or conduct of any third party supplier.
If you have allergies, sensitivities or medical concerns, you must raise these directly with the relevant supplier before using any product or service.
22. Locations, Venues and Permissions
Some sessions may take place in a studio, workspace, hired venue, outdoor location, client premises or other agreed location.
You are responsible for any location permissions, permits, access arrangements, parking, fees, restrictions or rules unless we agree otherwise in writing.
If we are unable to shoot at the agreed location due to lack of permission, access issues, unsafe conditions, restrictions, closure, weather or other circumstances outside our control, we may adapt the session, use an alternative location or reschedule where reasonable.
Additional costs may apply.
23. Weather and Outdoor Sessions
For outdoor or natural light sessions, weather and lighting conditions may affect the final images.
If the weather is unsuitable, we may suggest adjusting the time, changing location, moving indoors or rescheduling.
A decision to reschedule due to weather will be made at our discretion, taking into account safety, image quality and practicality.
24. Personal Comfort, Confidence and Boundaries
Unmuted Photography exists to help women feel seen, confident and powerful.
You are encouraged to tell us before or during the session if you have preferences, insecurities, boundaries, access needs, confidence concerns or anything that would help you feel more comfortable.
We will guide posing and direction with care, but you remain responsible for telling us if something feels uncomfortable, unsuitable or unsafe.
25. Health, Safety and Conduct
You agree to follow reasonable instructions during the session.
We reserve the right to stop, pause or cancel a session if we believe that continuing would be unsafe, inappropriate or damaging to any person, equipment, property or location.
Abusive, discriminatory, aggressive, intoxicated, unsafe or inappropriate behaviour will not be tolerated.
If a session is ended due to your conduct or the conduct of someone attending with you, no refund will be due.
26. Children, Guests and Additional People
Personal branding sessions are usually designed around the individual client unless agreed otherwise.
You must tell us in advance if you intend to bring children, guests, assistants, colleagues, family members, friends or pets to the session.
Additional people may affect timing, space, workflow and licensing, and may incur an additional fee.
Anyone attending the session must comply with these Terms and Conditions.
27. Printed Products
Where printed products are ordered, payment is required before the order is placed.
Printed products are custom made and cannot usually be cancelled or refunded once production has started, unless faulty.
Colours may vary slightly between screens and printed products due to differences in display settings, paper, print processes and calibration.
You are responsible for checking image choices, spelling, layout and product details before approving any print order.
28. Complaints and Issues
If you are unhappy with any part of the service, you must tell us in writing as soon as possible.
For issues relating to final images, you must raise your concerns within 7 days of gallery delivery.
We will review any concerns fairly and may, at our discretion, offer one or more of the following:
-
clarification;
-
minor additional editing;
-
replacement digital delivery;
-
partial refund;
-
reshoot, where appropriate.
A reshoot or refund will not be offered solely because you have changed your mind, do not like your outfit choice, hairstyle, make-up, expression, body image, location choice or creative style, where the service has otherwise been delivered with reasonable care and skill.
29. Limitation of Liability
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded.
Subject to this, our total liability to you is limited to the amount paid by you for the affected service.
We are not liable for:
-
indirect loss;
-
loss of profit;
-
loss of business;
-
loss of opportunity;
-
loss of goodwill;
-
loss caused by your failure to back up images;
-
third party supplier failure;
-
venue or location issues;
-
events outside our reasonable control.
30. Force Majeure
We are not liable for delay or failure to perform where this is caused by events outside our reasonable control.
This may include illness, accident, bereavement, severe weather, fire, flood, power failure, internet failure, equipment theft, transport disruption, government restrictions, venue closure, pandemic, civil unrest or any other event beyond our reasonable control.
Where possible, we will work with you to rearrange the affected service.
31. Data Protection and Privacy
We will process your personal information in order to manage your enquiry, booking, payment, session, image delivery and related services.
Personal information may include your name, contact details, business details, payment details, questionnaire responses, photographs, preferences and communications.
We will handle personal information in accordance with applicable UK data protection law and our Privacy Policy.
You are responsible for ensuring that any personal data you provide about other people is provided lawfully and with their knowledge where required.
32. Newsletter and Marketing
If you choose to subscribe to our newsletter or marketing updates, we may contact you with news, offers, updates and content from Unmuted Photography.
You can unsubscribe at any time.
Booking a session does not automatically require you to subscribe to marketing emails.
33. Website Use
You agree not to copy, reproduce, scrape, misuse or commercially exploit any images, text, branding, design, layout or content from the Unmuted Photography website without written permission.
All website content is protected by copyright and other intellectual property rights.
34. Changes to These Terms
We may update these Terms and Conditions from time to time.
The terms that apply to your booking will be the terms in force at the time your booking is confirmed, unless a change is required by law or agreed with you in writing.
35. Severance
If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining parts will continue to apply.
36. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the courts of England and Wales, unless consumer law provides otherwise.
37. Acceptance
By confirming a booking, paying a Booking Fee, attending a session or using images supplied by Unmuted Photography, you confirm that you have read, understood and agreed to these Terms and Conditions.
